If you've had an interaction with the criminal justice system, it's likely accessible through Indiana's court portal system, MyCase. Through this system, users are able to search for court records by name or case number. This service is offered free to the public. This means that anyone can search for anyone and find information on their case in a matter of seconds. One of the few ways to get information taken off of this system is through an expungement.
To start an expungement, you must file a petition with the court. The law requires a petition for an expungement to contain specific information relating to the petitioner and the case that is to be expunged. If you're not certain when you were arrested, if you were convicted, or what you were convicted of, MyCase can help answer some of those questions. Just search by your first and last name and scroll through the results until you find your case.
Once you find the case, scroll through the information on the page and find information relating to the disposition, or what happened with the case. Sometimes, this information is contained within long paragraphs, sometimes it is set out plainly. If you have trouble, answer a couple questions for us and we can help you out.
However, if your case isn't listed on MyCase, that doesn't mean that you don't have a criminal record. Below, we'll discuss how a fingerprint-based background check can make sure that all your records are included in your expungement petition.

As we mentioned before, some records may not be listed on MyCase. Regardless, these records will remain a part of your official record if they're not taken off. Requesting a copy of your fingerprint-based background check is the only way to find out if you have any other records.
If you have ever been fingerprinted in relation to an arrest, conviction, or even the investigation of a criminal offense, that information is most likely being maintained at the Indiana State Police Central Repository for Criminal History Information. Anytime your fingerprints are taken in relation to a violation of criminal law, a copy of those fingerprints are supposed to be transmitted to the Indiana State Police and then to the FBI, Criminal Justice Information Services (CJIS). This record is used as a biometric identifier to tie the court record to the individual.
A problem presents when a complete record is not transmitted to the State Police by local authorities. The Central Repository does not generate criminal records; it relies on local authorities to submit complete records. If the State Police has an incomplete record, they may be unable to determine if the record in the State Police system is the one that the court has expunged. Therefore, requesting a copy of your fingerprint-based background can be crucial to getting a record expunged. In fact, it is possibly the only way to be sure that all criminal records are properly expunged.
